Abstract

The right to housing, main goal of this paper, is a fundamental right, inserted inside Federal Constitution, of utmost importance to the attainment of the human dignity, but, unfortunately, it is not treated with the due importance by State, giving rise to one of the most serious problems of Brazilian society, which also spreads to other locations, which is the housing déficit. A closer analysis of the legal system allows us to affirm that there are alternatives to try to eliminate, or at least mitigate, this deficit, using some existing institutes (incorporation of vacant assets arising from abandonment and vacant inheritance) or by the establishment of new programs that may shed new light on the theme (such as social rental and compulsory rental). Primordial is that the State exercises its duties properly and seeks to guarantee everyone a decent housing.
