In the present article, it is intended to establish the legal nature of so-called permits for use or occupation in Chilean municipal legislation. the previous results important not only for municipal entities, but also for the administration or individual to whom they are conferred, In order that in said permission of use the rights are established in the said rights of use and obligations arising from each other, where to conclude that they are administrative acts that grant, whith character of revocable and precarious, the use and preferential enjoyment of certain public domain assets, nevertheless creating real administrative rights, ex novo, in favor of the owner, thereby excluding any form of arbitrariness on the part of the Administration that confers them at the time of eventually modifying or revoking them.
