Abstract

This article aims to analyze, through the Universal Declaration of Human Rights
and in the predictions of international texts, the changes that the concept of the
right to education has undergone, especially in relation to refugees. The
Universal Declaration was innovative in prescribing Education as a right for all,
but on the other hand it establishes a regressive scale on its access and
gratuity. The analysis of international and regional refugee protection
frameworks and instruments demonstrates that the right to education, from its
affirmation in the 1951 Convention to the most recent elaborations at the
regional level, constitutes an important agenda in the realization of rights, as a
way to local integration and social inclusion of the refugee population.
