CONTEMPORARY SLAVERY AND INTERNATIONAL RESPONSIBILITY OF BRAZIL: THE CONDEMNATION IN “THE CASE OF THE BRAZILIAN GREEN FARM WORKERS VS. BRAZIL"

Abstract

The present study has as its object of study the phenomenon of contemporary slavery in the context
of the International Responsibility of States, in order to analyze the measures resulting from this
accountability, with specific focus on the reality of Brazil, especially in light of its condemnation in the
“Case of Farmers Brazil Green Vs. Brazil”, the first litigation on contemporary slavery before the InterAmerican Court of Human Rights. Slavery, although formally overcome, is the root of several
problems faced in today's society, such as social inequalities and poverty, never having left the
Brazilian reality, becoming contemporary and, today, manifesting itself in the existence of several
cases of labor. slavery or the like, which eventually involve human rights management practices.
Faced with this reality, the research problem arises: “what are the impacts of the measures adopted
by Brazil to combat contemporary slavery?”. The general objective of the research is to explore the
effects of the international accountability of the Brazilian State due to the occurrence of contemporary
slavery in society. The study uses a legal-sociological approach, not focusing on dogmatic analysis,
deductive method (part of general premises to deduce the conclusion), bibliographic (consultation to
written secondary sources) and documentary (consult documents, such as international and internal
diplomas), descriptive end (describes the state of the art on the subject) and exploratory (seeks to
explore the issues addressed differently from usual). It is not the purpose of this research to present
an unquestionable solution that solves the existence of contemporary slavery situations. Far from this
claim, the study aims to verify the international aspects of labor security protection and to understand
how the legal system has implemented them, in accordance with the proposed objective.
