In Political Science Love is the result of Democracy and only in the Democratic State can the idea of "Love" prosper. Democracy allows for the idea of equality where the essence and legitimacy of the Legal World are no longer in the state and in the norms produced by it, but in Democracy, with "Love" being the ideal expression of Law. Love is the ultimate foundation of Law, and the love and dignity of the human person are two principles that are indissolubly linked. Affection has legal value, rising to the status of a true General Principle, affectivity being one of the principles of Brazilian family law implicit in the Federal Constitution of Brazil of 1988. What is much questioned in the analysis of fundamental rights is the fact that there is no absolute rights, since the rights are "relative" and can be object of the Weighting Theory. The dignity of the human person is a set of principles and values that has the function of ensuring that every citizen has his rights respected by the State. The dignity of an individual represents their "moral integrity" and an attack on that dignity is characterized as "moral damages".
