The present work tries to discuss the reflections of gender issues in the
creation and application of the law, as well as gender patrimonial violence in judicial
processes, seeking to reflect on the compatibility of a sentence with a perspective
from the metatheory of The fraternal right At first, it is discussed how gender
crossings symbolize a form of oppression and how the law is related to this condition,
followed by the discussion of patrimonial violence against women and the need to
bring evidence to the non-criminal processes, to end by reflecting on how fraternal
law indicates the need for a trial with a gender perspective that makes it possible to
change realities in accordance with international standards for the protection of
vulnerable people.
